This Privacy Policy describes VIBECHECK GROUP’s policies and procedures on the collection, use and disclosure of User information when Users use the Service and informs same about their privacy rights. This Privacy Policy applies to all of VIBECHECK GROUP’s electronic platforms. The below Privacy Policy is read in conjunction and subject to the Protection of Personal Information Act 4 of 2013 (“POPIA”) and any other relevant laws pertaining to the protection of a User’s personal information.

VIBECHECK GROUP use Users Personal data to provide and improve Our Service. By using the Service, Users agree to the collection and use of information in accordance with this Privacy Policy.

Interpretation and Definitions:

Interpretation

The words whose initial letters are capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Privacy Policy:

• Account means a unique account created for a User to access Our Service or parts of Our Service.
• Affiliate means an entity that controls, is controlled by, or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
• (The) Application refers to VIBECHECK GROUP, the software program provided by the Company – VIBECHECK GROUP (PTY) LTD
• VIBECHECK GROUP refers to the proprietary limited Company providing the Service.
• Country refers to the Republic of South Africa.
• Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.
• Personal Data is any information that relates to an identified or identifiable individual in accordance with POPIA or any other relevant law(s).
• (Our/The) Service refers to the Application.
• Service Provider means any natural or legal person who processes the data on behalf of VIBECHECK GROUP. It refers to third-party companies or individuals employed or procured by VIBECHECK GROUP to facilitate the Service, to provide the Service on behalf of VIBECHECK GROUP, to perform services related to the Service or to assist VIBECHECK GROUP in analysing how the Service is used.
• Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
• User(s) means the responsible person or individual accessing or using the Service, or the partner venue, or other legal entity on behalf of which such responsible part / individual is accessing or using the Service, as applicable.

Collecting and Using User Personal Data:

Type 1 – Personal Data

While using Our Service, VIBECHECK GROUP may ask Users to provide certain personally identifiable information that can be used to contact or identify Users, whether it may be partners venues or consumer Users. Personally identifiable information may include, but is not limited to:

• Email address
• First name and last name
• Phone number
• Address, Province, Postal code, City
• Usage Data

Type 2 – Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of Our Service that Users visit, the time and date of a Users visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When Users access the Service by or through a mobile device, VIBECHECK GROUP may collect certain information automatically, including, but not limited to, the type of mobile device Users use, Users mobile device’s unique ID, the IP address of the User’s mobile device and the mobile operating system, the type of mobile Internet browser Users use, unique device identifiers and other diagnostic data.

VIBECHECK GROUP may also collect information that a Users browser sends whenever the User visit or use Our Service or when Users access Our Service by or through a mobile device.

Information Collected while Using the Application:

While using Our Application, in order to provide features of Our Application, VIBECHECK GROUP may collect, with User prior permission:

• Information regarding User location; and
• Any pictures and/or other information from the User Device, as provided.

VIBECHECK GROUP use this information to provide features of Our Service and to improve and/or customize Our Service. The information may be uploaded to VIBECHECK GROUP servers and/or a Service Provider’s server.

Users can enable or disable access to this information at any time, through their Device settings.

Use of Your Personal Data:

VIBECHECK GROUP may use User Personal Data for the following purposes:

• To provide and maintain Our Service: including to monitor the usage of Our Service.
• To manage a User’s Account: to manage User registration as a User of the Service. The Personal Data provided can give Users access to different functionalities of the Service that are available as a registered User.
• For the performance of a Contract or Agreement: the development, compliance and undertaking of the agreement for the products, items or services Users have purchased or of any other agreement with VIBECHECK GROUP through Our Service.
• To contact Users: to contact Users by email, telephone calls, SMS or other equivalent forms of electronic communication, such as a mobile application’s push notifications regarding updates or informative communications related to the functionalities and/or product offerings of Our Service, including security updates, when necessary or reasonable, for their implementation.
• To provide Users: as the case may be, with news, special offers/promotions and general information about other goods, services and events which VIBECHECK GROUP offer that are similar to those that User’s have already purchased or inquired about unless Users have opted not to receive such information.
• To manage User requests: To attend to and manage User requests to VIBECHECK GROUP.
• For business transfers: VIBECHECK GROUP may use User information to evaluate or conduct commercial, restructuring, reorganization, dissolution, or other sale or transfer of some or all of its assets, whether as a going concern or as part of liquidation or similar proceeding(s), in which Personal Data held by VIBECHECK GROUP about Our Service, Users is among the assets transferred.
• For other purposes: VIBECHECK GROUP may use User information for other purposes, as the case may be, such as data analysis, identifying usage trends, determining the effectiveness of any promotional campaigns and to evaluate and improve Our Service, any products, marketing and User experience.

In accordance with POPIA, VIBECHECK GROUP may share User personal information in the following situations:

• With Service Providers: VIBECHECK GROUP may share User personal information with Service Providers to monitor and analyse the use of Our Service to contact User(s).
• For business transfers: VIBECHECK GROUP may share or transfer User personal information in connection with, or during negotiations of, any commercial agreements or sale of its assets, financing, or acquisition of all or a portion of VIBECHECK GROUP to another company.
• With Affiliates: VIBECHECK GROUP may share User information with our affiliates, in which case we will require those affiliates to honour this Privacy Policy. Affiliates include any other subsidiaries, joint venture partners or other companies that VIBECHECK GROUP control or that are under common control.
• With business partners: VIBECHECK GROUP may share User information with business partners to offer Users certain products, services or promotions.
• With other Users: as the case may be, when Users share personal information or otherwise interact in public areas with other Users, such information may be viewed by all Users and may be publicly distributed outside.
• With User consent: VIBECHECK GROUP may disclose User personal information for any other purpose with User consent.

To be mentioned herein, POPIA grants data subjects (Users / individuals) the following rights to control their personal information:

• The Right to be Notified
• The Right to Access Personal Information
• The Right to Object to Processing of the Information
• The Right to Refuse Automated Processing
• The Right to Submit a Complaint
• The Right to Correct or Delete any Personal Information
• The Right to institute civil proceedings

Retention of Your Personal Data:

VIBECHECK GROUP will retain User Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. VIBECHECK GROUP will retain and use User Personal Data to the extent necessary to comply with any legal obligations permitted in law and in accordance with POPIA, resolve disputes, and enforce legal agreements and policies.

VIBECHECK GROUP will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except in the case where this data is used to strengthen the security or to improve the functionality of Our Service or VIBECHECK GROUP are legally obligated to retain this data for longer periods.

Transfer of Your Personal Data:

User information, including Personal Data, is processed at the VIBECHECK GROUP operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of the User’s region or province, and potentially, outside of Republic of South Africa, where data protection laws may differ from those from within the jurisdiction of the Republic of South Africa.

The User’s consent to this Privacy Policy followed by the User’s submission of such information represents an agreement to that transfer. VIBECHECK GROUP will take all steps reasonably necessary to ensure that User data is treated securely and in accordance with this Privacy Policy and no transfer of User Personal Data will take place to an organisation or jurisdiction, unless there are sufficiently adequate controls in place, including the security of User data and other personal information.

Delete Your Personal Data:

A User has the right to delete or request that VIBECHECK GROUP assist in deleting the Personal Data that has been collected about the User. Our Service may give the User the ability to delete certain information about the User from within the Service.

The User may update, amend, or delete their information at any time by signing in to their Account, if they have one, and visiting the account settings section that allows the user to manage their personal information. The User may also contact VIBECHECK GROUP to request access to correct or delete any personal information that they have provided to VIBECHECK GROUP.

Please note, however, that in accordance with POPIA, VIBECHECK GROUP may need to retain certain information when there is a legal obligation or lawful basis to do so.

Disclosure of Your Personal Data:

Business Transactions

In the case where VIBECHECK GROUP is involved in a commercial or asset sale, one’s Personal Data may be transferred. VIBECHECK GROUP will provide notice before one’s Personal Data is transferred and may therefore become subject to a different Privacy Policy.

Law enforcement

Under certain circumstances, VIBECHECK GROUP may be required to disclose one’s Personal Data if required to do so by law or in response to valid requests by public authorities, such as a competent and recognised Court or duly authorised Government Agency etc.

Other legal requirements

VIBECHECK GROUP may disclose one’s Personal Data in good faith and the belief that such action is necessary, subject to the provisions of POPIA, to:

• Comply with any legal obligation(s);
• Protect and secure the rights or property of VIBECHECK GROUP;
• Prevent or investigate possible wrongdoing in connection with Our Service;
• Protect the personal safety of Users of Our Service or the public; and
• Protect against legal liability

Security of Your Personal Data:

The security of user Personal Data is fundamental and VIBECHECK GROUP is committed to safeguarding personal information from theft, any external exploitation, unlawful access and amendments or disclosure.

It is significant, however, to note that no method of transmission over the Internet, or method of electronic storage is 100% secure. While VIBECHECK GROUP strives to use commercially reasonable means to protect user Personal Data, the absolute security cannot always be guaranteed.

Detailed Information on the Processing of Your Personal Data:

The Service Providers which VIBECHECK GROUP use may have access to Your Personal Data. These third-party vendors collect, store, use, process and transfer information about User activity on Our Service in accordance with their Privacy Policies. VIBECHECK GROUP have conducted due diligence on said third party vendors and confirm that these third-party vendors are compliant with the relevant provisions of POPIA in terms of safeguarding the protection of Personal Data.

Usage, Performance and Miscellaneous:

VIBECHECK GROUP may use third-party Service Providers to maintain and improve our Service in the form of:

• Google Places

Google Places is a service that returns information about places using HTTP. It is operated by Google

Google Places service may collect information from a User and from their device for security purposes.

The information gathered by Google Places is held in accordance with the Privacy Policy of Google:

Children’s Privacy:

Our Service does not address anyone under the age of 18 (eighteen) years of age. VIBECHECK GROUP do not knowingly collect personally identifiable information from anyone under the age of 18 (eighteen) years of age. If the User of Our Service is a parent or guardian and is aware that a child (minor) has provided VIBECHECK GROUP with Personal Data, please contact VIBECHECK GROUP. In the case where VIBECHECK GROUP becomes aware that Personal Data from anyone under the age of 18 (eighteen) years of age has been collected without verification of parental consent, VIBECHECK GROUP shall take steps to remove that information from its servers.

In the case where VIBECHECK GROUP must rely on the consent as a legal basis for processing a User’s information and the User’s country requires such consent from a parent, VIBECHECK GROUP may require the User’s parent’s consent before the collection and use of said information.

Links to Other Websites:

Our Service may contain links to other websites and/or external pages that are not operated by VIBECHECK GROUP. By clicking on a third-party link, the User (as the case may be) will be directed to that third-parties site. We strongly advise review of the Privacy Policy of every site visited.

VIBECHECK GROUP have no control over and assume no responsibility for the content, privacy policies or practices of any third-party websites, external pages or services. All personal information is transferred to third parties via API (Application Programming Interface) using HTTPS (Hypertext Transfer Protocol Secure).

Changes to this Privacy Policy:

VIBECHECK GROUP may update this Privacy Policy from time to time and will send out a notification of any such changes by posting the new Privacy Policy on this page.

VIBECHECK GROUP will correspond via email and/or a prominent notice on Our Service, prior to the change becoming effective and update the “Last updated” date at the top of this Privacy Policy.

VIBECHECK GROUP shall confirm that the relevant provisions of POPIA and the content highlighted in this Privacy Policy is complied with through the reinforcement of requested conduct. It is noted herein, however, that VIBECHECK GROUP shall take appropriate actions, including sanctioning any User(s), against User(s) who through their conduct do not adhere to the content highlighted in this Privacy Policy.

It is advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
